The Clean Diamond Trade Act (Pub. L. 108-19, 2003) is the US legislation implementing the Kimberley Process Certification Scheme. The Act prohibits the importation into, or exportation from, the United States of any rough diamond, from any country that is not a Kimberley Process participant.
KPCS Certificate Requirements
All rough diamond imports into the US must be accompanied by a valid Kimberley Process certificate issued by the exporting country's government. The certificate must be presented to US Customs and Border Protection (CBP) at the time of import. Rough diamonds must be shipped in tamper-resistant containers with the KPCS certificate affixed to the outside.
US Customs Enforcement
CBP enforces the Clean Diamond Trade Act at US ports of entry. CBP officers verify that rough diamond shipments are accompanied by valid KPCS certificates and that the shipment details match the certificate. Non-compliant shipments may be seized and forfeited. Violations may result in civil or criminal penalties.
